Trey Cox & Jason Dennis: How to Recovery Attorneys' Fees in Texas

Attorney fee experts Trey Cox and Jason Dennis, partners at Lynn Tillotson Pinker Cox, LLP in Dallas, have authored, How to Recover Attorneys’ Fees in Texas, Third Edition 2014, published by Texas Lawyer.  This book is a step-by-step guide for practicing attorneys to help them win and defeat attorneys’ fees claims at trial.  They write:

“Once upon a time … a trial attorney threw a request for fees in his pleadings, prepared a one-paragraph designation of himself as the expert, and gave little thought to the fee claim until collecting their invoices prior to trial.  With little preparation, lead counsel could take the stand and opine in narrative fashion that all fees were reasonable, necessary, inextricably intertwined and ask for full recovery.  Those days are gone—both legally and factually.

Recovering attorneys' fees can no longer be an afterthought for trial lawyers and their clients. Today, the ability to recover attorneys' fees may be the deciding factor in whether or not to file a lawsuit and almost always plays a critical role in the decision to settle or try a case. In fact, it is no longer unusual for an attorneys' fees recovery to exceed actual damages.”

“At NALFA, we’d like to formally recognize this outstanding work of attorney fee scholarship, said Terry Jesse, Executive Director of NALFA.  “This book is an excellent resource for any practicing attorney seeking or opposing attorney fees in court or arbitration,” Jesse concluded.
